The rules that keep the platform fair, the work owned by the people who made it, and the community sustainable. Written by a founder, not a legal department.
Above Constraints exists to serve creators, not extract from them. These terms are written in plain language so you can actually read them. By using the platform you agree to what follows.
The deal
Above Constraints is a platform built by a solo founder in Italy for indie game developers, modders, and creators. It offers a public website, free courses, a Discord community, a publishing pipeline, and the Solutions toolkit.
Using any of it means you accept these terms and our Privacy Notice. If you do not accept them, do not use the platform.
Your account
- One human, one account. Don't share credentials. You are responsible for what happens under your login.
- Use accurate information when you sign up. Pick a username that doesn't impersonate someone else or a brand you don't represent.
- Tell us as soon as possible if you suspect your account has been compromised: info@aboveconstraints.com.
- You can delete your account at any time. We'll honour the request within the timelines in the Privacy Notice.
Your work stays yours
You retain full ownership of every game, course note, comment, asset, profile content, and submission you upload. The platform never claims copyright over user creations.
By posting content publicly on Above Constraints, you grant the platform a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content for the sole purpose of operating the service — for example, showing your game on the public games directory, your name on a credit, your profile to other users.
This licence ends when you remove the content or close the account. We do not license your work to third parties, train AI on it, or sell it.
- You confirm you have the rights to everything you upload (assets, music, footage included).
- You are responsible for the legality of what you publish.
- We may remove content that violates these terms, the law, or someone else's rights.
Platform content
The Above Constraints brand, design system, written content, code (where not open-source), and the Above-Chan character are owned by Above Constraints. You may link to, quote, and discuss them — please don't replicate the brand or pretend to be us.
Where parts of the platform are released as open-source (e.g. the VaRest Revived plugin), the licence in the relevant repository is what governs that piece.
Courses & knowledge
Course content on Above Constraints is a public good — free to learn from, free to apply, free to ship games with. You may not redistribute the videos, written material, or downloadable resources as your own product.
Knowledge gained from the courses is yours to use commercially without owing the platform anything. That is intentional.
Game publishing
When Above Constraints publishes a game on your behalf, the specifics — Steam Direct fee coverage, store-page handling, revenue split (if any), credits, marketing — are agreed in a separate, project-specific arrangement signed before publishing begins.
The default position: you own your game. We never acquire IP as a condition of publishing. If a future arrangement involves rev-share or co-development, it is explicit, in writing, and optional.
Community conduct
The platform exists so creators can build with elation. That requires a community where people aren't harassed, demeaned, or extracted from. The following are not tolerated:
- Harassment, hate speech, or targeted abuse of any individual or group.
- Unauthorised use of someone else's work, identity, or likeness.
- Spam, scams, undisclosed affiliate dumping, or pyramid-style recruitment.
- Sexually explicit content, content involving minors in any inappropriate context, or material that is illegal in Italy or the EU.
- Attempts to disrupt the service: scraping at abusive rates, exploits, denial-of-service.
- Malware, dangerous code, or unauthorised access to other accounts.
Critique is welcome. Cruelty isn't. Honest, constructive feedback is one of the platform's core values — please participate in that spirit.
AI features
Above-Chan and other AI-assisted tools are aids, not oracles. Their output may be wrong, incomplete, or out of date. Verify anything important. Do not paste secrets or sensitive personal data into chat features.
Messages sent through Above-Chan are processed via third-party AI providers under their own terms; we do not allow your conversations to be used to train third-party models.
Third-party services
Linking Discord, Patreon, Steam, YouTube, or other accounts is optional. Each linked service is governed by its own terms. Above Constraints is not responsible for outages, billing, or policy changes on those platforms.
Termination
You can stop using the platform and delete your account at any time, for any reason. We can suspend or close accounts that breach these terms or threaten the safety of the community — with as much notice as the situation allows.
On termination, the licence you granted us to host your public content ends. Cached copies and backups are removed in the ordinary course; logs follow the retention schedule in the Privacy Notice.
Disclaimers
The platform is provided "as is". We do our best to keep it stable, secure, and useful. We do not guarantee it will be uninterrupted, error-free, or that any specific outcome (publishing, audience, revenue) will result from using it.
Nothing on the platform is legal, financial, or professional advice.
Limitation of liability
To the maximum extent allowed by law, Above Constraints, its founder, contributors, and partners are not liable for indirect or consequential damages — lost profits, lost data, business interruption — arising out of using the platform.
Our total liability for any claim related to the service is limited to the greater of (a) the amount you paid Above Constraints in the 12 months before the claim, or (b) one hundred euros (€100). Mandatory consumer rights under Italian and EU law are not affected.
Governing law
These terms are governed by Italian law. Any dispute that cannot be resolved amicably falls under the exclusive jurisdiction of the competent courts in Italy, without prejudice to mandatory consumer protections that may apply in your country of residence.
Changes
When we update these terms, the date at the top changes. For material updates affecting your rights, we'll notify you by email or in-app banner before they take effect. Continued use after the effective date means acceptance of the new version.
